Please select today's date Please add the first homeowner's name Please add the second homeowner's name Please provide an email address so we can send a copy of the filled-out form Please add your address This Agreement, as authorized by the CC&R’s dated June 16, 1983 as amended, binds the parties to the below described understanding and detailed exception to the pre-existing CC&R’s, By-laws, and past practices of Phase Six Homeowners Association, Inc., also known as Briarwood VI and it’s Architectural Committee, and the Owner/s. The Owner/s have/has requested permission of the HOA and it’s Architectural Committee to deviate from the existing Regulations governing the HOA and it’s Architectural Committee and its’ management in a number of specific ways enumerated below. The HOA and its’ Architectural Committee is granting permission for the Owner to proceed with the listed exceptions in a manner as outlined only, with no deviation unless this Agreement is amended in writing. HOA has set 2018 as the time period for it to comply with the requirement to paint Owners houses and common area walls. Owner has requested permission to paint and in some cases otherwise redesign the façade of their home as soon as possible, in advance of 2018. This accord grants them permission to proceed at will, as outlined below. No Reserve Fund has been established to pay for this expenditure and past practice and understanding is Owners will be assessed for an equalized amount for the combined purposes. Owner agrees that all costs associated with his accelerated painting/redesign program will be borne by Owner with no exception. Owner indemnifies and will defend HOA against any claim from his contractor or otherwise, that emanates from Owners actions to avail himself of this independent work effort. HOA agrees to not assess Owner for painting at the later date when the HOA is maintaining the other properties, except for the amount attributed to the common area wall painting. ---Prior to painting all fascia wood & corbels must be properly repaired and primed.Please answer the following questions: Do you want to add stone to your home? YesNo Approved Stone and Paint choices and placement are attached in Addendum A Wooden gates must be painted the same color as the main house color. A homeowner that does not want to make any changes to the surface of the house may use any of the approved Dunn Edwards paint colors. Any front door replacements must be approved by the Architectural & Landscaping Committee. What paint color are you requesting to paint your home (must be provided by Dunn Edwards Paint Co.) All trim must match main house color; no contrasting colors. Garage door paint must match main house color paint. The Paint protocols attached require Owner to agree and comply with no exception and Owner will attest his paint contractor has complied with every detail. What materials are you requesting to use for Façade Matterials? And also what Façade design application are you using? This Agreement is related exclusively to the timing of painting and redesign of the façade of Owners home and for providing financial relief in 2018 from a HOA assessment, due to his personal cost of having incurred similar expense in painting earlier. It has no bearing or change to Owners responsibility for maintenance of the wood trim or other components of Owners home. Any disputes that arise from this Agreement will be resolved by the Architectural Committee and Owner agrees in advance to accept their Rulings and instructions.
